1. Acceptance of Terms

By accessing or using HistorIQly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years old to use this Service. If you are under 18, you must have parental consent to use the Service.

2. Description of Service

HistorIQly is an AI-powered educational platform that allows users to have conversations with AI representations of historical figures. The Service includes:

  • AI chat functionality with historical characters
  • Lesson modes for guided learning experiences
  • Debate modes featuring discussions between historical figures
  • Conversation history and export features
  • Subscription-based premium features

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Termination

You may delete your account at any time through Settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Generate content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity, or misrepresent your affiliation
  • Attempt to bypass, disable, or interfere with security features
  • Use automated systems (bots, scrapers) without our express permission
  • Reverse engineer, decompile, or attempt to extract the source code
  • Share your account credentials or allow unauthorized access
  • Use the Service for any commercial purpose without our consent
  • Generate content intended to spread misinformation as fact

5. AI-Generated Content Disclaimer

Important Notice About AI Content

The historical conversations provided by HistorIQly are generated by artificial intelligence and are for educational and entertainment purposes only.

  • AI responses are simulations based on historical data and may not accurately represent the actual views or statements of historical figures
  • Content should not be cited as primary historical sources
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • Users should verify any historical information through authoritative sources
  • AI may occasionally produce incorrect, biased, or inappropriate content despite our safeguards

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, and content (excluding user-generated content), is owned by HistorIQly and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

6.2 Your Content

You retain ownership of content you create using the Service. By using the Service, you grant us a limited license to store and process your content as necessary to provide the Service.

6.3 Feedback

Any feedback, suggestions, or improvements you provide may be used by us without any obligation to you.

7. Payments and Subscriptions

7.1 Billing

Paid subscriptions are billed in advance on a monthly or yearly basis. All payments are processed securely through Stripe.

7.2 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access to premium features until the end of your current billing period
  • No refunds are provided for partial billing periods
  • Refund requests within 7 days of initial purchase may be considered on a case-by-case basis

7.3 Price Changes

We reserve the right to modify pricing with 30 days notice. Existing subscriptions will be honored at their current rate until renewal.

8. BYOK (Bring Your Own Key)

If you use the BYOK feature with your own OpenRouter API key:

  • You are responsible for all charges incurred on your API account
  • We store your API key securely using AES-256-GCM encryption
  • You must comply with OpenRouter's terms of service
  • We are not responsible for any issues arising from your API usage

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS

10. Indemnification

You agree to indemnify and hold harmless HistorIQly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or the Service shall be:

  • First attempted to be resolved through good-faith negotiation
  • Subject to binding arbitration if negotiation fails (except for claims that may be brought in small claims court)
  • Governed by the laws of the jurisdiction where HistorIQly is registered

You agree to waive any right to participate in class action lawsuits against us.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
